Plaintiff Jerry Killian appeals by leave granted from an order of summary disposition in favor of defendants. We affirm.

Plaintiff filed a complaint on November 13, 1984. In his amended complaint, plaintiff alleged that he was arrested on or about October 11, 1979, and charged with the criminal offense of delivery of a controlled substance.
