PER CURIAM.

Defendant was charged with second-degree criminal sexual conduct, MCL 750.520(c)(1)(a); MSA 28.788(3)(1)(a). Following a jury trial in the Washtenaw Circuit Court, defendant was convicted of assault and battery, MCL 750.81; MSA 28.276. Defendant was sentenced to serve ninety days in the Washtenaw County Jail and was given credit for forty-five days served. Defendant appeals as of right.
