The defendant was indicted for the crimes of aggravated rape, kidnapping, and indecent assault and battery on a child who had attained the age of fourteen. After a jury trial he was convicted of the lesser included offense of rape on the indictment charging aggravated rape. The defendant was acquitted on the other two indictments.
