Police officers are exempt from prosecution for criminal possession of a weapon (Penal Law § 265.20), but does this exemption apply to a suspended police officer? Moreover, can a suspended police officer who carries a duplicate of his police shield be prosecuted for criminal possession of a forged instrument when he attempts to use the shield to identify himself as a police officer...
