In March 1985, plaintiff Richard G. Turk ("Turk") filed this lawsuit against defendants Richard McCarthy ("McCarthy") and the City of New York ("NYC" or "the City") seeking damages pursuant to 42 U.S.C. § 1983 and New York State common law.
