MEMORANDUM AND ORDER

HATFIELD, District Judge.

This action, prosecuted under the Federal Employers' Liability Act ("FELA"), 45 U.S.C. §§ 51 et seq., is before the court on motion of the defendant, Burlington Northern Railroad Company ("Burlington Northern"), requesting the court to enter partial judgment on the pleadings in its favor with respect to the claims advanced by Counts III, IV and V of the plaintiff's complaint.
