Forte, J.
This action was entered in the Lawrence Division of the District Court Department on October 14, 1982. Pursuant to G.L. c. 218, § 19B, the defendant claimed a trial by jury of six in the Haverhill Division.
On June 13, 1983, both parties filed a waiver of a jury trial. On October 14, the plaintiffs motion for summary judgment was granted by the Haverhill Division, but later reversed by the Appeals Court.
