These cases came on to be heard upon the appeals from the Court of Common Pleas of Hamilton County.

In December of 1985, the Hamilton County Grand Jury returned a joint, multi-count indictment against, inter alia, defendant-appellant Leonard Lundy ("Lundy") and defendant-appellant Phillip Nixon ("Nixon"). Lundy was charged in the indictment with four counts of aggravated robbery, one count of theft of drugs, two counts of drug abuse...
