MUNSON, J.

George V. Kain appeals the trial court's entry of summary judgment dismissing his action against Grant County. He contends Grant County should be estopped from raising the statute of limitation as a defense because of the failure of the Sheriff to timely serve the summons and complaint. We affirm.
