Defendants seek summary judgment on Counts II and III of the state court petition of plaintiff Fink, a former employee. Fink seeks actual and punitive damages for breach of the provisions of an alleged employment contract (Count II) and of an employer's duty of "good faith and fair dealing" (Count III). Defendants' contention is that plaintiff was an "at will" employee whose rights under Missouri law...
