Frank Lee filed an action under 42 U.S.C. § 1983 against the Town of Estes Park, a Colorado municipality, and three of its policeman, namely, Chief of Police Robert W. Ault, Sergeant Walter F. Kappely, and Officer Gregg Filsinger. Also joined as a party defendant was Odd Lyngholm, the operator of a Standard Oil gas station in Estes Park.
