HOUSTON, Justice.

The plaintiff, Willis Pennington, appeals from a judgment in favor of the defendants, Bobby Bigham, Patricia Bigham Smith, individually and as administratrix of the estate of John Thomas Bigham, and John Thomas Bigham, a minor.1 We reverse and remand.
