After a jury trial before a United States Magistrate, Joseph Birkenstock was convicted on four counts of willful failure to file income tax returns for the years 1980 through 1983, in violation of 26 U.S.C. § 7203. Birkenstock was sentenced to work release for six months to be followed by three years of probation and a fine of $30,000. In addition, Birkenstock was ordered to file returns for the years at issue and to pay the costs of prosecution...
