This appeal arises from a dispute over the amount of certain District of Columbia inheritance taxes. Appellants paid the taxes under protest and then sought a partial refund by filing an appeal in the Tax Division of the Superior Court under D.C.Code § 47-3303 (1986 Supp.). The court granted the District's motion for summary judgment. We hold that the record does not support the award of summary judgment to the District; accordingly, we reverse the...
