Plaintiff Donohue appeals from an order of the trial court granting defendant's motion for a new trial following entry of judgment on a jury verdict for plaintiff.

In September 1976, plaintiff was beaten and sustained severe injuries in a fight which occurred in Logan, Utah. He was taken from Logan to Intermountain Health Care's (IHC) McKay-Dee Medical Center in Ogden, Utah, where he was treated for those injuries by Dr. Cloyd Van Hook and members...
