Appellant, James Alfred Nichols, was convicted of second degree theft, in violation of § 13A-8-4, Code of Alabama 1975. The trial court sentenced appellant to a term of five years' imprisonment, suspended, with three years' supervised probation, fined him $1,000 plus court costs, and ordered him to pay restitution in the amount of $681.20.
