Plaintiff Stephen M. Kula filed a three-count complaint in the Circuit Court of Cook County, Illinois, after he was discharged by his employer J.K. Schofield & Co., Inc. ("Schofield & Co."). In count I of the original complaint Mr. Kula alleged that Schofield & Co. breached his employment contract.
