This matter is now before the Court upon the Petitioner's second petition for federal habeas corpus relief under 28 U.S.C. § 2254. Petitioner Evans pled guilty to the capital murder of a grocery store clerk in October of 1981, and the court proceeded to hold a trial on the sole issue of what sentence he should receive.
