This diversity action is before the Court on the defendants' various motions to dismiss. The motions assert the complaint fails to state a claim upon which relief can be granted, Fed.R.Civ.P. 12(b)(6), and fails to allege fraud with particularity, Fed.R. Civ.P. 9(b).
