This matter is before this court upon the trial court's denial of appellants' motion for summary judgment. Appellees, an employee union and eighteen individual state employees, filed this action in 1980, pursuant to Section 1983, Title 42, U.S. Code, seeking a declaration of their constitutional rights, in regard to disciplinary suspensions.
