In this cause, Plaintiff, Auto Club Insurance Association (Auto Club), seeks reimbursement from an employee benefit plan (the Plan) for benefits paid out under a no-fault automobile insurance policy. Auto Club also seeks a declaratory judgment that, this action is not preempted by ERISA and the Plan is obligated under M.C.L.A. § 500.3109a to reimburse Auto Club as well as any other no-fault insurer doing...
