This appeal arises out of a vehicular collision with a pedestrian. We reverse.

The plaintiff's parents, both individually and on his behalf, sued the driver of the truck, the driver's insurer, the driver's employer, and the State of Louisiana. The suit against the State was settled for $1000 and dismissed.
