BUTTLER, Presiding Judge.

Defendant was convicted in municipal court under a city ordinance prohibiting DUII. He appealed his conviction to the circuit court, where he was convicted after a trial de novo. On appeal to this court, he contends that the trial court erred in failing to hold that an amendment of the state statute prohibiting DUII rendered Salem's DUII ordinance, which incorporated the state statute before its amendment, invalid.
