The plaintiff, who is a corporal in the police department of the City of Hinton (West Virginia) filed this 42 U.S.C. § 1983 action complaining of an alleged violation of his fifth amendment rights by reason of a disciplinary suspension of one day imposed for a refusal to comply with a known regulation of the police department.
