Plaintiff, Minus J. Taylor, appeals from a summary judgment granted in favor of defendant, Mutual of Omaha Insurance Company (Mutual).

On or about December 9, 1982, plaintiff injured his back working on a derrick barge. At the time he was employed by H & B Marine (H & B) which, subsequent to the accident, began paying him maintenance and cure.
