OPINION

BROOKSHIRE, Justice.

The grand jury of Montgomery County indicted Calvin Lee Johnson on the charge of attempted capital murder under the terms of section 19.03 of the Texas Penal Code. The indictment, in capsule form, charged that the Appellant:

"[W]ith specific intent to commit the offense of capital murder of Barbara Brown, attempt to intentionally cause the death of Barbara Brown by shooting...
