This is an action in rem brought under the Court's admiralty jurisdiction. Plaintiff Zidell, Inc. ("Zidell") seeks to foreclose its lien against the cargo, freight, and subfreight of the BARGE ZPC 404, owned by Zidell and chartered to Shemya Constructors, Inc. ("Shemya"). Zidell moves for summary judgment dismissal of the counterclaims of claimant Shemya and partial summary judgment on Zidell's own claims...
