This appeal concerns a claim for excessiveness of sentence after defendant was resentenced by order of a remand for resentencing from the United States Fifth Circuit Court of Appeal for a 1977 conviction. The defendant, Gilbert D. Guzman, was indicted for possession of heroin with intent to distribute, a violation of LSA-R.S. 40:966(A)(1).
