PIVARNIK, Justice.

Petitioner Corwin Karr Stoehr was charged with Murder. The Prosecutor requested the death penalty. Subsequently, problems involving the availability of State's witnesses contributed to the State and Petitioner entering into a written plea agreement. On April 25, 1983, Petitioner withdrew his plea of not guilty and entered a plea of guilty to murder. The Court accepted the guilty plea and sentenced Petitioner to thirty-five (35) years imprisonment...
