The defendant, Eric Neal Cortez, was charged with second-degree burglary of a dwelling, section 18-4-203, 8B C.R.S. (1986), and theft by receiving, section 18-4-410, 8B C.R.S. (1986). An Adams County District Court jury acquitted the defendant of burglary and found him guilty of theft by receiving. The court of appeals reversed the defendant's conviction because the prosecution failed to prove venue in Adams County on the theft by receiving charge...
