DEVANY, Justice.

Larry William Padgett appeals his conviction for driving while intoxicated. Appellant waived trial by jury and entered a plea of nolo contendere. The court found appellant guilty and assessed his punishment at 60 days confinement in the Dallas County Jail and a $100 fine.
