OPINION

KELTNER, Justice.

This is an appeal from Timothy Eugene Yeary's conviction for driving while intoxicated in violation of TEX.REV.CIV.STAT. ANN. art. 6701l-1 (Vernon Supp.1987). The trial was to a jury which found Yeary guilty and the court sentenced Yeary to three months confinement in the Tarrant County jail and a fine of $500.00.

We affirm.
