This constitutes the second time petitioner Richard Tucker's application for 28 U.S.C. § 2254 federal habeas corpus relief, has been before this court. In 1978, a Bibb County, Georgia jury found the petitioner Richard Tucker, Jr. guilty of malice murder and kidnapping with bodily injury. Tucker was sentenced to two death penalties.
