Petitioner was convicted in an Illinois circuit court of rape and unlawful restraint and sentenced to terms of imprisonment of ten and three years respectively. The Illinois Appellate Court (1st Dist.) affirmed the rape conviction but vacated the conviction and sentence for unlawful restraint. The Illinois Supreme Court subsequently denied leave to appeal.
