DUNN, Justice.

This is an appeal from the trial court's judgment denying appellant Crown Central Petroleum indemnity for punitive damages assessed against it in favor of appellees, Joe Jennings and Michael Dragon.

Jennings and Dragon sued Crown and Mundy Construction Company for actual and punitive damages. Jennings and Dragon were injured in July 1981, when David Waller, a Mundy employee, drove a forklift into an overhead piperack at Crown...
