Plaintiff Chris Trueba ("Trueba") initiated this personal injury action against Flota Bananera Ecuadorian Lines, Inc. ("Flota"). The action was tried before this Court January 12 and 13, 1987 on the sole issue of liability. At the close of plaintiff's case in chief, defendant moved for dismissal of the action contending that plaintiff had failed to make out a prima facie case. Whereupon defendant rested its case...
