The defendant Bates was indicted for aggravated rape. A jury found defendant guilty of forcible rape. (La.R.S. 14:42.1). A presentence investigation was ordered and reviewed. Defendant was subsequently sentenced to serve 30 years at hard labor, five years to be served without benefit of probation, parole or suspension of sentence.
