The defendant was charged with having committed the class B misdemeanor of driving while intoxicated, first offense. § 577.010. In a jury-waived trial, the court found him guilty. He was fined $400 and sentenced to 60 days in the Greene County Jail. The sentence was suspended and the defendant was placed upon probation for two years.
