SEERDEN, Justice.

This is a personal injury case which, on appeal, involves only questions concerning the failure of the trial court to submit special issues on gross negligence and exemplary damages. Larry Hylander, as temporary administrator of the estate of Eddie Baggett and Shirley Uthoff, individually, and as administrator of the estate of Edward Sullivan and as next friend of her minor child, Shirley Baggett, sued Groendyke Transport, Inc....
