This is a case where the consumer [Michael Kinerd] recovered treble damages1 and attorney's fees under the Deceptive Trade Practices-Consumer Protection Act [TEX.BUS. & COM.CODE ANN. sec. 17.41 et seq. (Vernon Supp.1987) ] plus penalties and attorney's fees for usury under TEX. REV.CIV.STAT.ANN. art 5069-1.06 (Vernon 1987).
