State appeals from the trial court's order dismissing Counts I, II and IV of the Indictment charging Heinz Neumann, defendant-appellee ("Neumann"), with two counts of Forgery in the Second Degree in violation of Hawaii Revised Statutes ("HRS") § 708-852 and one count of Criminal Possession of a Forgery Device in violation of HRS § 708-854(1)(b).
