Defendant Kenneth Valentine ("Valentine") has moved for an order pursuant to Fed.R.Crim.P. 33, setting aside the jury verdict in this case and ordering a new trial or, in the alternative, granting a factual hearing on the basis of newly discovered evidence of prosecutorial misconduct.
