On January 29, 1980, defendant was convicted of first degree murder and sentenced to death. On appeal, this Court affirmed the conviction of first degree murder but reversed the death penalty and remanded for a resentencing hearing. State v. Adkins, 653 S.W.2d 708 (Tenn. 1983).
