OPINION

BILLINGS, Judge:

James D. Conder ("Conder") filed suit against A.L. Williams & Associates, Inc. ("Williams"), Massachusetts Indemnity and Life Insurance Company ("MILICO"), and Bryce D. Peterson ("Peterson") alleging five causes of action stemming from an employment contract. The district court granted partial summary judgment thereby dismissing the first cause of action alleging fraud and misrepresentation in the inducement of the contract....
