Robert S. Tafoya, a Mexican-American citizen of the United States, was terminated from his employment with the Department of Parks and Recreation for the City and County of Denver on January 20, 1984. On January 24, 1984, Tafoya filed a charge with the Equal Employment Opportunity Commission (EEOC). On April 30, 1984, the EEOC issued Tafoya a notice of right to sue.
