Harold E. Traster died January 20, 1982, eight days after undergoing surgery for rectal cancer. His wife, Clara, filed a wrongful death action against the hospital, a first-year resident employed by the hospital, and Dr. Otto Steinreich, M.D., the surgeon. She alleged negligence both in the performance of the surgery and in postoperative care.
