Edward James Babin, plaintiffs/appellees' decedent, was killed in an industrial accident on June 28, 1983, while employed by Shell Oil Company as a warehouseman. On November 30, 1983, suit, naming several defendants, was originally filed in the Twenty-Ninth Judicial District Court, Parish of St. Charles, Civil Action No. 26,858. That suit was removed to Federal Court, No. 84-2259, at which time Shell Oil Company intervened pursuant to the Louisiana Worker...
