This action arose under the Lanham Act, 15 U.S.C. § 1051 et seq., and under the law of the State of New York. Plaintiff Duracell Inc. ("Duracell") sought to enjoin the infringement of its trademarks, the illegal importation of goods bearing its trademarks, and unfair competition and for damages resulting therefrom.
