On November 6, 1986, a jury found appellant Andrew Joseph Forcier guilty of criminal sexual conduct in the third degree. Minn.Stat. § 609.344, subd. 1(c) (1986) (sexual penetration accomplished through force or coercion). Pursuant to the judgment of conviction, appellant was sentenced to a 41-month term of imprisonment.
