A jury found the appellant guilty of murder and assessed punishment at 40 years confinement.

The appellant does not challenge the sufficiency of the evidence. The record reflects that when the police arrested the appellant, he first confessed to committing an assault upon the decedent, and then to murder. The appellant also informed the police of the location of the murder weapon, a hammer, and the shirt he wore when committing...
